Privacy policy

We understand that your trust in us is the most important asset of “BVBA DX-SOLUTIONS”  (hereinafter referred to as “DX-SOLUTIONS”, “we” or “us”). Your privacy is therefore of paramount importance to us.

This privacy statement (hereinafter referred to as the “Privacy Statement”) applies, among other things, to (i) our website https://dx-solutions.be (hereinafter referred to as the “Website”) and (ii) all (commercial) relationships between DX-SOLUTIONS and its customers, suspects, prospects and business partner.

This Privacy Statement includes information about the personal data that DX-SOLUTIONS collects, as well as how DX-SOLUTIONS uses and processes this personal data.

DX-SOLUTIONS wishes to emphasise that it endeavours at all times to act in accordance with the “Privacy Legislation”, namely EU Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, as well as the transposition of this European Regulation into Belgian law, which entered into force on 5 September 2018 and repeals the Belgian Privacy Act of 1992.

Visiting the Website, using the services of DX-SOLUTIONS, subscribing to the newsletter, registering for a seminar, webinar, event, etc. implies your express consent (by providing your personal data or opt-in) to the Privacy Statement and therefore to the way in which DX-SOLUTIONS collects, uses and processes your personal data.

Please read this Privacy Statement in conjunction with the legal disclaimer and cookie policy of DX-SOLUTIONS.

DX-SOLUTIONS also automatically collects anonymous information  about your use of the Website. For example, DX-SOLUTIONS will automatically log which sections of the Website you visit, which web browser you use and which website you were visiting when you accessed the Website. We cannot identify you from these data, but they allow DX-SOLUTIONS to compile statistics on the use of the Website.

II. Method of collecting personal data

This personal data is collected when or in the context of:

  • Visiting the Website
  • Working with DX-SOLUTIONS

  • Filling in the contact form on the Website
  • Subscribing to the newsletter (whether or not via the Website)

  • Your attendance at a trade fair, webinar, event, seminar, etc.

The personal data collected by DX-SOLUTIONS is therefore expressly and voluntarily provided by you.

Providing certain personal data is (sometimes) a prerequisite for accessing certain services (e.g. to subscribe to newsletters, to participate in certain activities and events). In such cases, it is indicated which data is mandatory and which is optional.

DX-SOLUTIONS may use your personal data for the following purposes:

  • The performance of a contract with DX-SOLUTIONS (incl. follow-up)
  • Follow-up after a meeting
  • The preparation of a quotation (and the sending thereof)
  • Answering questions (whether or not asked via the contact form)
  • The creation of a (demo) account and the confirmation thereof
  • Providing support/assistance (e.g. in case of problems)
  • Confirmation of registration for a webinar, seminar, event, etc.
  • Sending invoices and collecting payments
  • Sending targeted marketing and advertising, updates and promotional offers on the basis of your communication preference and – where applicable – on the basis of your explicit approval
  • Carrying out customer satisfaction surveys, polls and other market research
  • Optimising the quality, management and content of the Website
  • Sending newsletters

Processing takes place on the following legal bases, as applicable:

  • You have given consent to the processing of your personal data for one or more specific purposes
  • Processing is necessary for the performance of the contract with DX-SOLUTIONS or to take steps at your request prior to entering into a contract
  • Processing is necessary for compliance with a legal obligation to which DX-SOLUTIONS is subject
  • The processing is necessary to protect your vital interests or those of another natural person
  • The processing is necessary for the performance of a task carried out in the public interest
  • Processing is necessary for the purposes of the legitimate interests pursued by DX-SOLUTIONS or by a third party, except where your interests or fundamental rights and your fundamental freedoms requiring the protection of personal data override those interests (in particular where you are a minor)

IV. Disclosure of personal data to third parties

DX-SOLUTIONS will not disclose your personal data to third parties unless this is necessary for the performance of the agreement and its optimisation (such as, but not limited to, the provision of services to DX-SOLUTIONS (i.e. through subcontracting) and in connection with cloud storage, communication and creditworthiness checks). In this context, your personal data may be disclosed to external consultants, software suppliers, a cloud partner and financial institutions.

If it is necessary for DX-SOLUTIONS to disclose your personal data to third parties in this context, the third party concerned is required to use your personal data in accordance with the provisions of this Privacy Statement.

Without prejudice to the foregoing, DX-SOLUTIONS may nevertheless disclose your personal data:

  • To the competent authorities (i) when DX-SOLUTIONS is required to do so by law or in the context of current or prospective legal proceedings and (ii) to safeguard and defend the rights of DX-SOLUTIONS.
  • If DX-SOLUTIONS or substantially all of its assets are acquired by a third party, in which case your personal data that DX-SOLUTIONS has collected will be one of the transferred assets.

In all other cases, DX-SOLUTIONS will not sell, rent or disclose your personal data to third parties, unless it has (i) obtained your consent to do so and (ii) entered into a data processing agreement with the third party concerned, which contains the necessary guarantees regarding confidentiality and privacy-compliant handling of your personal data.

V. Grensoverschrijdend e verwerking persoonsgegevens

Any transfer of personal data outside the European Economic Area (EEA) to a recipient domiciled or established in a country not covered by an adequacy decision issued by the European Commission shall be governed by the provisions of a data transfer agreement, which will either (i) contain the standard contractual clauses set out in the ‘European Commission Decision of 5 February 2010 (Decision 2010/87/EC)’, or (ii) provide appropriate safeguards through any other mechanism under the Privacy Legislation or any other regulations concerning the processing of personal data

VI. Opslag persoonsgegevens

Unless a longer retention period is required or justified (i) by law or (ii) by compliance with other regulations, DX-SOLUTIONS retains your personal data only for the period necessary to achieve and fulfil the purposes, as described in this Privacy Statement under ‘III. Use of personal data’.

VII. Your privacy rights

In connection with the processing of your personal data, you have the following privacy rights:

  • Right of access to your personal data;
  • Right to rectification, completion or updating of your personal data;
  • Right to erasure of your personal data (‘right to be forgotten’) (DX-SOLUTIONS does, however, draw your attention to the fact that certain services will no longer be accessible or cannot be provided if you erase or request the erasure of certain necessary personal data);
  • Right to restriction of the processing of your personal data;
  • Right to portability of your personal data;
  • Right to object to the processing of your personal data.

You may, in principle, exercise these rights free of charge using the form above. You may also, at any time, use your account to check the personal data that you were required to provide when creating your account, update it, and/or modify it.

If you no longer wish to receive newsletters or information about the services of DX-SOLUTIONS, you can unsubscribe at any time by clicking the “unsubscribe” button provided at the bottom of each automated email from DX-SOLUTIONS.

VIII. Beveiliging persoonsgegevens

DX-SOLUTIONS undertakes to take appropriate and reasonable physical, technological and organisational security measures with a view to preventing (i) unauthorised or unlawful access to your personal data, as well as (ii) loss, misuse or alteration of your personal data. DX-SOLUTIONS will store all personal data that it has collected in the cloud with data centres in the EU and, where applicable, on the hardware used by DX-SOLUTIONS staff. Notwithstanding (i) the security policy of DX-SOLUTIONS, (ii) the checks it carries out and (iii) the actions it takes in this regard, an infallible level of security cannot be guaranteed. No method of transmission or transfer over the internet, nor any method of electronic storage, is 100% secure, so DX-SOLUTIONS cannot guarantee absolute security in this regard.  Finally, the security of your account will also depend on keeping your password and other account information confidential. DX-SOLUTIONS will never ask for your password, nor will you be required to disclose it yourself. If you nevertheless disclose your password to a third party, that third party will gain access to your account and your personal data using your password. In that case, you are personally liable for any actions resulting from the use of your account. DX-SOLUTIONS therefore strongly recommends that you change your password immediately if you discover that someone has access to your account, and contact DX-SOLUTIONS without delay.

IX. Update Privacy V erklaring

DX-SOLUTIONS is entitled to update this Privacy Notice by publishing a new version on the Website. In this context, you are strongly advised to consult the Websites and the relevant page displaying the Privacy Notice regularly to ensure that you are aware of any changes.

X. References to other websites

The Website may contain hyperlinks to other websites. When you click on one of these links, you may be taken to another website or internet resource that could collect information about you deliberately or through cookies or other technologies. DX-SOLUTIONS has no responsibility, liability or control over these other websites or internet resources, nor over their collection, use and disclosure of your personal data. You should check the privacy policies of these other websites and internet resources yourself to determine whether they comply with Privacy Legislation.
